City Counselor Seeks Stay of Federal Judge’s Order

On Monday, a federal judge issued an order that could result in the release of pretrial detainees who may pose a risk to public safety.
The City Counselor has filed a stay seeking to temporarily stop the judge’s order. Our concern is for the safety of our residents, visitors, and businesses.
The federal court has set a very short time period of seven days to grant nearly 900 felony detainees new bail hearings under new standards, or release them immediately. Virtually all detainees currently placed in City custody by the courts are accused of serious felony charges.
They include: 92 charged with murder; 23 with other degrees of homicide; 71 with first-degree assualt; 96 with first-degree robbery; and 72 with domestic violence, sexual offenses (including against children), and violations of protection orders.
The City supports bail reform and the protection of everyone’s constitutional rights. It is out of an abundance of caution that the City is seeking a stay of the federal court judge’s order
