Overview

An ordinance extending paragraph (G) of Section Two of Ordinance 63481, approved on June 2, 1995, as extended by Ordinance 66316, and in lieu thereof a new paragraph is enacted extending the period of time during which the Westminster/Lake Special Business District shall be permitted to collect the tax within the boundaries of the district therein established; and containing effectiveness and emergency clauses.

The tax provided for by this ordinance shall only be levied and collected for tax years 2015, 2016, 2017, 2018, 2019, 2020, 2021, 2022, 2023 and 2024.

Location:

Beginning at the intersection of the center-lines of Kingshighway Boulevard and the north Westminster Place alley; thence westwardly along the center-line of said alley across Lake Avenue to the intersection of the center-lines of said alley and Union Boulevard; thence southwardly along the center-line of said boulevard to the intersection of the center-lines of said boulevard and the south Westminster Place alley; thence eastwardly along the center-line of said alley and its prolongation across the property owned by New City School and Lake Avenue to the intersection of the center-lines of said alley and Kingshighway Boulevard; thence northwardly along the center-line of said boulevard to the point of beginning.

Board Duties and Purpose

SECTION FIVE:

All District revenues collected hereunder by the Collector of Revenue, except for those revenues expended for the necessary costs of the establishment and administration of the District, and for collection fees for tax revenue collected hereunder, may only be used to carry out any and all of the following improvements, services and activities related to security of the District:

A. To provide special police and/or security facilities, equipment, vehicles and/or personnel for the protection and enjoyment of the property owners and the general public within the District; and

B. If hereafter approved by the Board of Aldermen upon the recommendation of the Board of Commissioners, and after a public hearing before said Board of Aldermen, or one of its committees, District tax revenues may also be used:

1. To prohibit or restrict vehicular traffic on streets and alleys within the District and to provide the means for access by emergency and refuse vehicles to or in such areas; and/or

2. To close existing City-owned streets or alleys or to open new streets and alleys or to widen or narrow existing City-owned streets and alleys in whole or in part within the District; and/or

3. To construct, install, improve and/or maintain useful or necessary or desired security related improvements. Provided, however, that if any such proposed additional use is recommended by the Board of Commissioners, said Board shall be required to mail a pre-printed postcard to each registered voter and each property owner within the District notifying them of the time, date, place and purpose of the Aldermanic Public Hearing required above.

Said Board shall be responsible for placing addresses and postage on the pre-printed postcards and delivering them the Clerk of the Board of Aldermen, not later than 15 days prior to the public hearing with a list of all registered voters within the district and their addresses provided by the Board of Election Commissioners and a list of all property owners within the District and their mailing addresses provided by the Assessor.

When Clerk is satisfied that the Board of Commissioners has provided all the required postcards, he, or she, shall cause the postcards to be mailed immediately.

Member Requirements

Appointments require Board of Aldermen approval.

The Board of Commissioners shall consist of seven (7) members, and shall be appointed by the Mayor with the advice and consent of the Board of Aldermen, of whom five (5) members shall be owners of real property within the District or their representatives and two (2) members shall be renters within the District or their representatives.

SECTION FOUR.

There shall be a Board of Commissioners to administer the District. The Board of Commissioners shall be selected as follows:

A. Membership:

The Board of Commissioners shall consist of seven (7) members, and shall be appointed by the Mayor with the advice and consent of the Board of Aldermen, of whom five (5) members shall be owners of real property within the District or their representatives and two (2) members shall be renters within the District or their representatives.

B. Term of Office:

Each member of the Board of Commissioners shall serve for a 4-year term (except as provided herein with respect to the initial members), with terms expiring as of December 31st of the designated year or when their successors are appointed as provided herein, whichever is later.

D. Removal:

The Mayor with approval of the Board of Aldermen may remove any member of the Board of Commissioners for misconduct or neglect of duty upon written charges and after a public hearing.

E. Vacancies:

Vacancies on the Board of Commissioners, occasioned by removal, resignation, expiration of term, or otherwise, shall be reported in writing to the Mayor by the Board of Commissioners. The vacancy shall be filled in like manner as an original appointment no later than thirty (30) days after the date of said report to the Mayor. Appointments to fill vacancies shall be for the unexpired portion of a term only.
