Overview

A Community Improvement District, to be known as the “South Grand Community Improvement District” (hereinafter referred to as the “District”), is hereby established and extended to receive services, benefits, and assessments as set forth in Appendix A, which is attached hereto and incorporated herein by reference.

Board Duties and Purpose

The District is authorized by the Act to use a sales tax and any one or more of the assessments or other funding methods specifically authorized by the Act to provide funds to accomplish any power, duty or purpose of the District;provided however, the District shall not have the authority to impose any assessment on any real property located in a special business district authorized pursuant to Mo. Rev. Stat. § 71.790 et seq. or on any business or individual doing business in such special business district until the taxes imposed by such special business district have been repealed by such special business district.

Member Requirements

Appointments require Board of Aldermen approval.

The Petition provides that the District shall be governed by a Board of Directors ("The Board") consisting of nine (9) individual directors, such Directors to be appointed by the Mayor of the City with the consent of the Board of Aldermen by resolution. The board of directors shall in addition include up to four (4) ex officio non-voting members, including the Alderman within the District or the appointed representative of each of them.

Each member of the Board of Directors other than the ex officio members, shall (i) be at least eighteen (18) years of age; and (ii) be and must declare to be either (a) an owner or the designated representative of real property ("Owner") within the District; (b) an owner or the designated representative of a business ('operator") operating within the District; or (c) a registered voter ('Resident") residing within the District, as provided in the Act.

In order to ensure a fair representation of the District, the Board representation shall be (i) at least five (5) of the Directors shall be "Owners", and (ii) at least three (3) of the Directors shall be "Operators".

The Directors shall serve a four (4) year terms, and each shall serve until his or her successor is appointed. All successor Directors, whether o serve a new term or to fill a vacancy on the Board, shall be appointed by the Mayor of the City with the consent of the Board of Aldermen by resolution according to the slate submitted to the City Clerk by the Board.
