Third Party Food Delivery and Establishments

Board Bill

The Board Bill would impose certain transparency requirements and restrictions on “third-party food delivery services” and “food establishments”, as these terms are defined in in the Bill. These include requirements that third-party food delivery services and food establishments disclose their policies regarding delivery worker gratuities, that third-party food delivery services disclose the commissions charged food establishments for online orders taken through their platforms, and require that food establishment’s their Health Department performance and risk-based inspection letter grades on platforms used to take online orders. The Board Bill would also prohibit third-party food delivery services from imposing requirements regarding food establishments’ prices for online orders, cap delivery fees at 5%, and require third-party food delivery services to obtain business licenses.
