71312 COVID-19 Additional Federal Funding
The United States government recently has enacted legislation appropriating additional funding for City activities and distributions related to the COVID-19 pandemic. In this Ordinance, the Board of Aldermen authorizes the receipt of and appropriates funds (solely to the extent received) from the Department of the Treasury for emergency rental and other housing assistance, from the Department of Health and Human Services for emergency health programs, and under the Low-Income Household Drinking Water and Wastewater Emergency Assistance Program; and containing an emergency clause. Appropriation of this funding will greatly benefit the public by providing resources for addressing housing instability, public health, and utility needs during the pandemic.

71225 Covid-19 Response Grant for Board of Elections
This Board Bill authorizes the Board of Elections to accept the Center for Tech and Civic Life (the “CTCL”) Covid-19 Response Grant of $1,034,200.00 to provide financial assistance to local election officials (“LEOs”) for expenses incurred between June 15, 2020 and December 31, 2020, associated with the safe administration of election responsibilities, including safe election day administration; poll worker recruitment, training and safety efforts; voter education and outreach for safe voting policies and procedures; and expanding and maintaining early in-person voting sites and expedited and improved vote-by-mail ballot processing. The grant limits reimbursement to expenses incurred between June 15 and December 31, 2020, in accordance with an assessment called “Safe Voting Plan” prepared by the STL BEC. The grant precludes supplanting previously appropriated funds to BEC or the reduction in budgeted funds to the BEC during the term of this grant unless CTCL grant funds are to be returned.

The Property is the two playgrounds on each side of Webster School. The Board of Education has maintained the Property since the school was built. The City will transfer the Property to the Board of Education to allow the Board of Education to have ownership of the Property that the Board of Education has always maintained.

71186 Police Use of Force Policies
The overall purpose and/or reasons for the bill is to direct the Commissioner of the St. Louis Metropolitan Police Department to provide updates to the St. Louis Metropolitan Police Department’s Use of Force Policy. The bill will require the Commissioner of Police to update the Use of Force Policy to include: 1. Ban officers from using chokeholds or strangleholds as a use of force method; 2. Require officers to use de-escalation tactics when appropriate and possible in place of use of force tactics; 3. Establish a duty to intervene policy, which would require officers to either stop or attempt to stop another sworn employee when force is being inappropriately applied or is no longer required; and 4. Edit the current use of force reporting policy to include comprehensive reporting and require officers to complete a report if a weapon is drawn and pointed at a civilian(s) regardless if the weapon was discharged or not. The bill will improve the current use of force policy enacted by the St. Louis Metropolitan Police Department, which could lead a better relationship between the police and the communities they serve. As the Ferguson Commission report states, "The regular use of force has led many citizens to view the police as an occupying force in their neighborhoods, damaging community trust and making community safety even more difficult." According to the report, efforts to repair the relationship between police and the communities they serve "must begin through changes in use-of-force policies."

71179 Expansion of the Port Authority District Boundaries
Overall Purpose/Reasons for the Board Bill The City of St. Louis Port Authority port district boundaries currently include approximately 6,000 acres, primarily along the City’s 19-mile riverfront. Every other port district in Missouri is coterminous with the boundaries of the city or county (or counties) that created the port district. Examples include Kansas City, St. Louis County and Jefferson County. Expanding the boundaries of the City of St. Louis Port Authority as proposed by Board Bill Number 28 will allow the City of St. Louis Port Authority to qualify for additional federal and state grant programs and to participate in development and infrastructure projects throughout the expanded boundaries, as described below. What the Board Bill Will Do Expand the boundaries of the City of St. Louis Port Authority as shown on the map attached as Exhibit A to Board Bill Number 28. The Impact of the Board Bill to the Community Over the last 10 years, the City of St. Louis Port Authority has received approximately $1 million from the Port Security Grant Program administered by the Federal Emergency Management Agency for video surveillance along the riverfront and to supplement technology at the Real Time Crime Center. A larger port district will enable the Port Authority to qualify for additional federal and state grant programs, including but not limited to the Port Security Grant Program, for City-wide safety and security enhancements and other eligible purposes. In 2016, the Missouri General Assembly authorized port authorities to create Advanced Industrial Manufacturing (AIM) zones. Within an AIM zone, a port authority may receive one-half of State withholding taxes attributable to new jobs within the zone. A larger port district will enable the Port Authority to leverage these state funds for a wide range of infrastructure and other development purposes within the AIM zone. In 2010, the Missouri General Assembly authorized port authorities, with the approval of the Missouri Highways and Transportation Commission and the circuit court, to create Port Improvement Districts upon request of property owners within the boundaries of any proposed district. Similar to a transportation development district or a community improvement district, the qualified voters within a Port Improvement District may elect to impose a sales tax and/or a property tax to fund qualified costs within the boundaries of the Port Improvement District. A larger port district will enable the City of St. Louis Port Authority to make this job-creation program available in more parts of the City.

The City of St. Louis owns and maintains Dr. Martin Luther King Drive and Hadley Street as public streets within the City. 900 North is the owner of constructed improvements located at 900 N. Tucker in the City of St. Louis, Missouri. InterCo Plaza consists of several parcels located along Dr. Martin Luther King Drive (“InterCo Plaza"), which is adjacent to the 900 North Building, adjoined by Saint Louis Public Schools, Northside Regeneration, and the City of St. Louis. 900 North is purchasing property that abuts the streets and is located at 900 N. Tucker. 900 North desires to make certain improvements to the streets and the related City-owned facilities. The City desires to allow owner to make improvements to the streets and exclusively use the streets, subject to the terms and conditions of a Cooperation Agreement. The proposed board bill will have a positive impact on the community, as it will improve infrastructure and beautification in the relevant area.

900 North is the owner of constructed improvements located at 900 N Tucker in the City of St. Louis, Missouri (“900 North Building”). InterCo Plaza consists of several parcels located along Dr. Martin Luther King Drive (“InterCo Plaza"), which is adjacent to the 900 North Building. Pursuant to a Maintenance Agreement, the City of St. Louis will grant 900 North a permit to enter upon InterCo Plaza to perform maintenance services directly to InterCo Plaza, which services shall include landscape improvements, mowing and trimming the grass, trees, and shrubs. Overall Purpose/Reasons for the Board Bill The Soccer Stadium Redevelopment Area consists of approximately 34.7 acres, including rights-of-way, and is generally comprised of I-64 exit and entrance ramps and associated rights-of-way, Aloe Plaza West park, surface parking, and vacant and occupied commercial buildings. The Soccer Stadium Redevelopment Plan contemplates that the Redevelopment Area will be redeveloped for use as a stadium and associated team facilities, but Aloe Plaza West will remain a public park owned by the City. The Redevelopment Plan contemplates 25 years of real property tax abatement on the value of improvements constructed within the Redevelopment Area, as well as certain other incentives. To implement those incentives, the Redevelopment Plan and the Redevelopment Area must qualify under both the LCRA Law (Chapter 99) and the Urban Redevelopment Corporation Law (Chapter 353). What the Board Bill Will Do Approves the Redevelopment Plan under the LCRA Law. Key points: • Declares the Redevelopment Area as “blighted” under the LCRA Law. • Approves condemnation for property located at 2008-2012 Olive Street. • Requires Redeveloper to comply with all City requirements relating to non-discrimination and MBE and WBE utilization. • A companion Board Bill (Board Bill Number 215) approves declares the Redevelopment Area to be blighted under Chapter 353 and approves a Master Redevelopment Agreement and other documents in connection with the project. The Main Components of the Board Bill The Project • Approximately 22,500-seat professional soccer stadium. • Team offices. • Practice fields. • Parking facilities. • Renovated Aloe Plaza West (which will remain a City-owned public park). • Various street, sidewalk and utility improvements. Available Incentives • 25-year real property tax abatement on the assessed value of the stadium (the Redeveloper will pay real property taxes on the value of the underlying land during this period). • Sales tax exemption on the purchase of construction materials used to complete the stadium and related team facilities. • Creation of a community improvement district and transportation development district (each imposing a 1% sales tax) to assist in funding public infrastructure components of the project. • If the port district is extended to include the project site (which would require passage of a separate board bill), the potential creation of a port improvement district (that would impose a 1% sales tax) to assist in funding public infrastructure components of the project. • Abatement of amusement tax (which is already applicable for this type of project pursuant to Chapter 8.08 of the City Code). Redeveloper Responsibilities and Obligations • Acquire the property and construct the project. • Comply with generally applicable MBE/WBE, competitive bidding, prevailing wage, First Source employment and living wage requirements. • Keep the stadium and related facilities in good repair. • Cooperate with the LCRA to identify potential locations for off-site parking that would be beneficial to both fans attending soccer matches and businesses in the downtown west area. • If the team relocates within 10 years, pay to the City the sum of $15 million reduced by $1.5 million for each year or portion thereof that the team operates within the City. City/LCRA Responsibilities and Obligations • Facilitate the incentives described above. • Cooperate with the Redeveloper to acquire the necessary property. • Cooperate with the Redeveloper to identify and obtain other funding sources, such as assistance from the State of Missouri. • Cooperate with the Redeveloper with respect to signage, security, marketing, traffic management, street maintenance, sidewalk utilization, construction staging, etc. in generally the same manner as the City cooperates with the Cardinals and the Blues. The Impact of the Board Bill to the Community The Board Bill will incentivize the Redeveloper to invest more than $500 million in the City to attract an expansion Major League Soccer franchise and construct a professional soccer stadium and related team facilities.

This Board Bill seeks to approve a Chapter 99 Redevelopment Plan and Blighting Study for the 2127 North 11th St. Redevelopment Area. This Board Bill will allow up to fifteen (15) years of tax abatement as follows: ten years (10) years of tax full abatement followed by five (5) years of tax abatement based on 50% of the assessed value of incremental improvements. The project consists of renovation of the vacant Webster school in the Old North neighborhood. The prospective redeveloper plans renovating the school into 45 senior citizen residential units, and building 4 units behind the school, all 2 bedrooms, at the cost of $ 8.1 million. The redeveloper plans to utilize LIHTC and private funds for this project.

71088 Expansion of St. Louis Square, Inc. operations
Overall Purpose/Reasons for the Board Bill This Board Bill will facilitate personal property tax abatement and sales and use tax exemption incentives in connection with Square, Inc.’s expansion of its St. Louis operations, which includes the creation of more than 250 jobs and the relocation of Square’s St. Louis offices to the former Post-Dispatch building located at 900 N. Tucker Boulevard. What the Board Bill Will Do This Board Bill will authorize an industrial revenue bond transaction that will facilitate the following incentives: • 10 years of personal property tax abatement (75% abatement in years 1 – 5; 50% abatement in years 6 – 10); • Sales and use tax exemption on the purchase of personal property; and • Sales and use tax exemption on the purchase of construction materials used for tenant improvements The industrial revenues bonds will be purchased by Square and will be payable only from lease revenues paid by Square, and not from any City tax revenues. The City approved similar industrial revenue bond transactions for Anheuser Busch in 2018 (Ordinance No. 70921), in 2017 for Huvepharma (Ordinance No. 70590), and in 2015 for Square’s initial expansion into St. Louis (Ordinance No. 70132). The Main Components of the Board Bill The Board Bill (1) approves a Plan for an Industrial Development Project, which is attached as Exhibit A to the Board Bill, as is required by Chapter 100, RSMo. for this type of incentive, and (2) authorizes the issuance of the industrial revenue bonds to facilitate the above-described incentives. The Impact of the Board Bill to the Community The Board Bill will incentivize Square to create invest approximately $45 - $50 million in the City and create more than 250 jobs. A Cost/Benefit Analysis describing the financial impacts of the tax incentives on the various taxing districts is included in Exhibit A to the Board Bill and will be sent to each of the taxing districts, as required by Chapter 100, RSMo.

71072 Unlawful Possession of a Handgun by a Minor
The purpose of this bill is to create the municipal ordinance violation of Unlawful Possession of a Handgun by a Minor under the age of eighteen (18) years. While the State of Missouri preempts most of the field of gun regulation, this bill seeks to take advantage of the federal law prohibiting, except in certain exempted circumstances, a juvenile from possessing a handgun, and to create a regulation to enforce this prohibition that is consistent with regulation allowed by state statute. This bill includes a Penalty provision for violation which is not to exceed $500.00 in fines, and/or 30 days incarceration. This bill is an exercise of the police power of the City of St. Louis with the goal of improving safety for all, creating a new tool to use against gun violence, and averting future problems by addressing gun possession by minors. This bill should have a positive impact on the community.

71041 Gun Background Check
An ordinance establishing reporting requirements for dealers selling firearms to report failures of a background check system when a firearm purchase is denied within the limits of the City of St. Louis. In 2018, there were 1,419 aggravated assaults with a firearm in the City of St. Louis. To date, there have been more than 1,700 aggravated assaults with a firearm in the City. The increased use of guns and the flow of illegal guns into the City has negatively impacted the overall safety of the residents. Additionally, the State of Missouri does not require a background check prior to the transfer of a firearm between unlicensed parties. The State also does not require firearms dealers to obtain a state license. In Missouri, all firearm transfers by licensed dealers are processed directly through the National Instant Criminal Background Check System. If an applicant fails the National Instant Criminal Background Check System, there are no reporting requirements regarding the failed background check.
